Welcome to Roomie Remote. These Terms of Service ("Terms") govern your access to and use of the Roomie Remote website located at roomieremote.com (the "Site") and any related services provided by Roomie Remote Inc. ("Company," "we," "us," or "our"). By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Acceptance of Terms

By accessing, browsing, or otherwise using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Site on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Roomie Remote provides a universal remote control application for Apple devices (iPhone, iPad, Mac, Apple Watch, and Apple TV) that enables users to control audiovisual equipment, smart home devices, and home automation systems. The Site serves as the marketing and informational platform for the Roomie Remote application and related services. Features, pricing, and availability of the app and its services are subject to change without notice.

3. Subscriptions & Billing

Certain features of the Roomie Remote application require a paid subscription. Subscriptions are billed through the Apple App Store and are subject to Apple's terms and conditions for in-app purchases and subscriptions. By subscribing, you agree to the following:

  • Subscription fees are charged at the beginning of each billing period (monthly or annually, depending on your selected plan).
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • You may manage or cancel your subscription through your Apple ID account settings.
  • Refunds are handled by Apple in accordance with their refund policies. We do not process refunds directly.
  • We reserve the right to change subscription pricing upon reasonable notice. Price changes will take effect at the start of your next billing cycle following the notice.

4. User Conduct

You agree to use the Site and our services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates any applicable federal, state, local, or international law or regulation.
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site.
  • Use the Site to transmit any viruses, malware, or other harmful code.
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site.
  • Use any automated system, including bots, scrapers, or crawlers, to access the Site without our express written permission.
  • Reverse engineer, decompile, or disassemble any portion of the Site or its underlying software.

5. Intellectual Property

All content, features, and functionality on the Site — including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof — are the exclusive property of Roomie Remote Inc. or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Roomie Remote name, logo, and all related product and service names, design marks, and slogans are trademarks of Roomie Remote Inc. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

6. Disclaimers

THE SITE AND ALL CONTENT, MATERIALS, INFORMATION, SERVICES, AND PRODUCTS AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information on the Site. Your use of the Site is at your sole risk.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROOMIE REMOTE INC., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE OR ANY CONTENT ON THE SITE.

In no event shall our total liability to you for all claims arising out of or relating to the Site exceed the amount you paid to us, if any, during the twelve (12) months preceding the event giving rise to such liability.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the courts of the State of California or the United States District Court for the relevant district in California. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice by updating the "Last updated" date at the top of these Terms. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms. You are advised to review these Terms periodically for any changes.
